1. Apparently the Delhi High Court Judges met in Full Court on 9 February 2022 to decide on opening up the Delhi High Court now that almost all Covid related restrictions have been lifted in Delhi. Why then has no official communication in this regard still been issued to the public. The Rajya Sabha was told by the Law Minister Rijiju that 19895 cases are pending before the Delhi High Court which are between 5-10 years old. The total pendency is much higher. 2. How was the case on the constitutionality of the marital rape exception being heard by the Delhi High Court when it was only supposed to be hearing extremely urgent cases on account of Covid restrictions. 3. The Supreme Court of India has announced that it is reverting to the case hearing procedure that it was following till December 2021. Why do the Supreme Court Judges not want the Court to open up fully. Why have physical hearings on only two days in a week starting next week. 4. What is driving this abdication of their judicial duty by these Supreme Court Judges and Delhi High Court Judges? Seema Sapra

Does the law apply to Harish Salve's Bentley?

Does the law not require the registration of an FIR? 



The undisputed facts are that a man died in a car accident involving two cars - A Wagon R (driven by the man who died) and a Bentley (owned by Harish Salve). 

A man died in a motor accident - does the law not require a police investigation into culpability after registration of an FIR? The investigation might conclude that the accident was caused by the deceased or it might conclude that the Bentley driver was culpable in causing death due to rash or negligent driving. 

But is an FIR not the necessary first step that must precede a full police investigation?

These are not "loose and unsubstantiated allegations". These are valid comments, there is something called transparency, the Radia tapes mention of Gopal Subramaniam is on the record, and it shows that Radia had access to him as Solicitor General on 2G issues, how and why?

Remember the uproar created by the CBI about Raja's lawyers being present during a CBI meeting with Gopal Subramaniam on 2G?

The questions about the Afzal Guru trial, the Kasab trial and the cover up of the larger conspiracies in both attacks (Parliament and Mumbai seige)are not invalid. There are credible questions asked by many persons of credibility in the public domain about what really happened and who was involved in the attacks. Both Guru and Kasab were small fry.

It would be a fair comment that there were serious issues/ questions as to whether Guru and Kasab got a fair trial.

Look up the wiki-leaks cables on Kasab's trial and you will appreciate my point that the trial could not be described as fair.

The Bar Council of India has prescribed Rules on the professional standards that an advocate needs to maintain as mentioned in Chapter II, Part VI of the Bar Council of India Rules. These rules have been placed there under section 49(1) (c) of the Advocates Act, 1961.

Rule 7 of the “RULES ON AN ADVOCATE’S DUTY TOWARDS THE COURT” prescribed by the Bar council of India reads:

7. Refuse to appear in front of relations
An advocate should not enter appearance, act, plead or practice in any way before a judicial authority if the sole or any member of the bench is related to the advocate as father, grandfather, son, grandson, uncle, brother, nephew, first cousin, husband, wife, mother, daughter, sister, aunt, niece, father-in-law, mother-in-law, son-in-law, brother-in-law daughter-in-law or sister-in-law.”
The Bar Council of India rules on professional standards and professional ethics therefore prohibit a relative of a sitting Delhi High Court Judge from appearing as advocate before the Delhi High Court.
In violation of these rules and in particular Rule 7 reproduced hereinabove, Mr Gurmehar S. Sistani, the son of sitting Delhi High Court Judge J. G S Sistani has been appearing and filing matters before the Delhi High Court since 2011. A search on the Delhi High Court website reveals that Gurmehar Singh Sistani filed 3 matters before the Delhi High Court in 2011, 5 matters before the Delhi High Court in 2012, 14 matters before the Delhi High Court in 2013, and has filed 3 matters before the Delhi High Court in the current year - 2014.
A perusal of the orders passed in the matters filed by Gurmehar Singh Sistani shows that he has obtained favourable orders in every matter filed by him.
I reproduce below an example of a highly suspect order obtained by Gurmehar Singh Sistani on 17 February 2014 from the Court of J. Sunil Gaur, where an FIR was quashed after a dubious compromise in a case of a non-compoundable offence under Section 304-A of the Indian Penal Code.

    Quashing of FIR No.248/2013, under Sections 336/338 of IPC registered at police station Mayapuri, Delhi is sought on the basis of Settlement of 29th January, 2014 (Annexure P-3).
 
  Notice.
 
  Mr. Ravi Nayak, learned Additional Public Prosecutor for respondent- State accepts notice and points out that Section 304-A of IPC has been also added.
 
  Mr. Siddharth Thakur, Advocate, appears on behalf of respondents No.2 to 4 and submits that respondents No.2 to 4 are complainant party and they are present in the Court.
 
  Learned Additional Public Prosecutor for respondent/State submits that respondents No.2 to 4, present in the Court, have been identified to be complainant party by their is counsel as well as by ASI Dipender  Singh on the basis of identity proof produced by them.
 
  Respondents No.2 to 4, present in the Court, submit that there are no other legal heirs of the deceased and the dispute between the parties  has been amicably resolved vide aforesaid Settlement and that the  incident in question was purely accidental and that now they have been  suitably compensated and the misunderstanding which led to registration of the FIR now stands cleared between the parties. Respondents No.2 to 4
  submit that the terms of aforesaid Settlement have been fully acted upon as today, they has received the balance settled amount of ` 6.5 lacs by way of banker's cheque bearing No. 107182 of 5th February, 2014.

  Respondents No.2 to 4 affirm the contents of aforesaid Settlement and of their affidavits of 13th February, 2014 supporting this petition and submits that now no dispute with petitioner survives and so, the proceedings arising out of the FIR in question be brought to an end.
 
  In "Gian Singh Vs. State of Punjab"(2012) 10 SCC 303 Apex Court has
  recognized the need of amicable resolution of disputes in cases like the
  instant one, by observing as under:-
 
  ?61. In other words, the High Court must consider whether it would
  be unfair or contrary to the interest of justice to continue with the
  criminal proceedings or continuation of criminal proceedings would
  tantamount to abuse of process of law despite settlement and compromise
  between the victim and the wrongdoer and whether to secure the ends of
  justice, it is appropriate that criminal case is put to an end and if the
  answer to the above question(s) is in the affirmative, the High Court
  shall be well within its jurisdiction to quash the criminal proceedings.?
 
    Considering the fact that the burn injuries sustained by deceased  due to short-circuit at the premises in question and the said incident  was a sheer accident and that legal heirs of deceased have been suitable compensated, I find that continuance of proceedings arising out of the FIR in question would be an exercise in futility.
 
  Accordingly, this petition is allowed and FIR No.248/2013, under Sections 336/338 of IPC registered at police station Mayapuri, Delhi and the proceedings emanating therefrom stand quashed qua petitioner.
 
  This petition is accordingly disposed of.

Ms Nayamat Sistani who is also appearing before the Delhi High Court also appears to be a relative of Judge G S Sistani..

Mr Gurmehar S Sistani is a young lawyer who has only about four years standing at the Bar. Yet, in 2013 he filed 14 matters before the Delhi High Court surpassing many of his older, more experienced colleagues at the Bar.

Prima facie it appears that Mr Gurmehar S Sistani is exploiting his father’s position as a sitting Judge of the Delhi High Court to obtain clients and favourable orders.

Judge G S Sistani’s role in this undesirable situation must also be probed.

The Bar Council of India’s prohibition on relatives of sitting judges from practicing in the same Court is to guard against a relative corruptly exploiting the Judge’s position for commercial gain and to prevent a Judge from influencing (whether actively or passively) the orders passed by other Judges of the same Court in matters filed by a close relative of a Judge.

While Gurmehar S Sistani has failed to comply with Bar Council of India’s professional standards and ethics rules, Delhi High Court Judge G S Sistani has failed to comply with his constitutional oath of probity and his obligation to ensure that no family member puts him in a situation of manifest conflict of interest or acts so as to convey an impression to the public and the Bar that his son is obtaining pecuniary benefits from his legal practice by exploiting his ties to a sitting Delhi High Court Judge.

Such situations where close relatives of sitting Judges practice law in the same Court not only convey an impression of judicial corruption, but also engender actual judicial corruption. Litigants are often led to believe that engaging a close relative of a sitting Judge will result in favourable orders from the court.

I request the President of India, the Bar Council of India, the Bar Council of Delhi, the Chief Justice of India, and the Chief Justice of the Delhi High Court to take cognizance of this complaint against Delhi High Court Judge G S Sistani and his son Gurmehar S Sistani and relative Nayamat Sistani.

The Bar Council of India has prescribed Rules on the professional
standards that an advocate needs to maintain as mentioned in Chapter
II, Part VI of the Bar Council of India Rules. These rules have been
placed there under section 49(1) (c) of the Advocates Act, 1961.



Rule 7 of the "RULES ON AN ADVOCATE'S DUTY TOWARDS THE COURT"
prescribed by the Bar council of India reads:



"7. Refuse to appear in front of relations

An advocate should not enter appearance, act, plead or practice in any
way before a judicial authority if the sole or any member of the bench
is related to the advocate as father, grandfather, son, grandson,
uncle, brother, nephew, first cousin, husband, wife, mother, daughter,
sister, aunt, niece, father-in-law, mother-in-law, son-in-law,
brother-in-law daughter-in-law or sister-in-law."

The Bar Council of India rules on professional standards and
professional ethics therefore prohibit a relative of a sitting Delhi
High Court Judge from appearing as advocate before the Delhi High
Court.

In violation of these rules and in particular Rule 7 reproduced
hereinabove, Mr Gurmehar S. Sistani, the son of sitting Delhi High
Court Judge J. G S Sistani has been appearing and filing matters
before the Delhi High Court since 2011. A search on the Delhi High
Court website reveals that Gurmehar Singh Sistani filed 3 matters
before the Delhi High Court in 2011, 5 matters before the Delhi High
Court in 2012, 14 matters before the Delhi High Court in 2013, and has
filed 3 matters before the Delhi High Court in the current year -
2014.

A perusal of the orders passed in the matters filed by Gurmehar Singh
Sistani shows that he has obtained favourable orders in every matter
filed by him.

I reproduce below an example of a highly suspect order obtained by
Gurmehar Singh Sistani on 17 February 2014 from the Court of J. Sunil
Gaur, where an FIR was quashed after a dubious compromise in a case of
a non-compoundable offence under Section 304-A of the Indian Penal
Code.

Quashing of FIR No.248/2013, under Sections 336/338 of IPC
registered at police station Mayapuri, Delhi is sought on the basis of
Settlement of 29th January, 2014 (Annexure P-3).

Notice.

Mr. Ravi Nayak, learned Additional Public Prosecutor for respondent-
State accepts notice and points out that Section 304-A of IPC has been
also added.

Mr. Siddharth Thakur, Advocate, appears on behalf of respondents
No.2 to 4 and submits that respondents No.2 to 4 are complainant party
and they are present in the Court.

Learned Additional Public Prosecutor for respondent/State submits
that respondents No.2 to 4, present in the Court, have been identified
to be complainant party by their is counsel as well as by ASI Dipender
Singh on the basis of identity proof produced by them.

Respondents No.2 to 4, present in the Court, submit that there are
no other legal heirs of the deceased and the dispute between the
parties has been amicably resolved vide aforesaid Settlement and that
the incident in question was purely accidental and that now they have
been suitably compensated and the misunderstanding which led to
registration of the FIR now stands cleared between the parties.
Respondents No.2 to 4
submit that the terms of aforesaid Settlement have been fully acted
upon as today, they has received the balance settled amount of ` 6.5
lacs by way of banker's cheque bearing No. 107182 of 5th February,
2014.


Respondents No.2 to 4 affirm the contents of aforesaid Settlement
and of their affidavits of 13th February, 2014 supporting this
petition and submits that now no dispute with petitioner survives and
so, the proceedings arising out of the FIR in question be brought to
an end.

In "Gian Singh Vs. State of Punjab"(2012) 10 SCC 303 Apex Court has
recognized the need of amicable resolution of disputes in cases like the
instant one, by observing as under:-

?61. In other words, the High Court must consider whether it would
be unfair or contrary to the interest of justice to continue with the
criminal proceedings or continuation of criminal proceedings would
tantamount to abuse of process of law despite settlement and compromise
between the victim and the wrongdoer and whether to secure the ends of
justice, it is appropriate that criminal case is put to an end and if the
answer to the above question(s) is in the affirmative, the High Court
shall be well within its jurisdiction to quash the criminal proceedings.?

Considering the fact that the burn injuries sustained by deceased
due to short-circuit at the premises in question and the said incident
was a sheer accident and that legal heirs of deceased have been
suitable compensated, I find that continuance of proceedings arising
out of the FIR in question would be an exercise in futility.

Accordingly, this petition is allowed and FIR No.248/2013, under
Sections 336/338 of IPC registered at police station Mayapuri, Delhi
and the proceedings emanating therefrom stand quashed qua petitioner.

This petition is accordingly disposed of.

Ms Nayamat Sistani who is also appearing before the Delhi High Court
also appears to be a relative of Judge G S Sistani..



Mr Gurmehar S Sistani is a young lawyer who has only about four years
standing at the Bar. Yet, in 2013 he filed 14 matters before the Delhi
High Court surpassing many of his older, more experienced colleagues
at the Bar.



Prima facie it appears that Mr Gurmehar S Sistani is exploiting his
father's position as a sitting Judge of the Delhi High Court to obtain
clients and favourable orders.



Judge G S Sistani's role in this undesirable situation must also be probed.



The Bar Council of India's prohibition on relatives of sitting judges
from practicing in the same Court is to guard against a relative
corruptly exploiting the Judge's position for commercial gain and to
prevent a Judge from influencing (whether actively or passively) the
orders passed by other Judges of the same Court in matters filed by a
close relative of a Judge.



While Gurmehar S Sistani has failed to comply with Bar Council of
India's professional standards and ethics rules, Delhi High Court
Judge G S Sistani has failed to comply with his constitutional oath of
probity and his obligation to ensure that no family member puts him in
a situation of manifest conflict of interest or acts so as to convey
an impression to the public and the Bar that his son is obtaining
pecuniary benefits from his legal practice by exploiting his ties to a
sitting Delhi High Court Judge.



Such situations where close relatives of sitting Judges practice law
in the same Court not only convey an impression of judicial
corruption, but also engender actual judicial corruption. Litigants
are often led to believe that engaging a close relative of a sitting
Judge will result in favourable orders from the court.



I request the President of India, the Bar Council of India, the Bar
Council of Delhi, the Chief Justice of India, and the Chief Justice of

ISLAMABAD: Foreign judicial delegations from Turkey, Nigeria, Libya,
USA and India participating in the "International Judicial Conference
2014" called on Chief Justice Tassaduq Hussain Jillani in his Chamber
before the inauguration of the Conference.

The conference is being held in the Supreme Court building,here on Friday .

The delegation of Turkey headed by Jsutice Dr. Alparslan Altan, Vice
President, Constitutional Court of the Republic of Turkey comprising
Justice Serdar Ozguldur, President, Court of Jurisdictional Disputes
Ankara , Turkey , Ms. Birgul Yigit, Rapporteur Judge, Court of
Jurisdictional Disputes of the Republic of Turkey and Ufuk Yesil,
Secretary General, Court of Jurisdictional Disputes of the Republic of
Turkey, delegation of Nigeria comprising Justice Kashim Zannah, Chief
Judge, Maiduguri, Borneo State, Nigeria, delegation of Libya
comprising Justice Jebril E.S Bin Saleh, Judge, Supreme Court of
Libya, Justice Farag A.M Ben Aesha, Judge, Supreme Court of Libya and
Abdul Basit Moftah El-Ashaal, Public Prosecutor, Public Prosecution of
Libya, delegation of USA comprising John Clifford Wallace, Judge of
the United States Court of Appeals Washington D.C, USA and Jeffrey A.
Apperson, Vice President, National Centre for State Courts, delegation
of India comprising Rakesh Munjal, Senior Advocate, Supreme Court of
India and Amarjit Singh Chandhiok, Senior Advocate, India met the
Chief Justice of Pakistan and discussed matters related to judiciary,
issues of mutual judicial interest and cooperation between the
Judiciary of Pakistan and their respective judiciaries.

Welcoming the foreign delegates, the Chief Justice of Pakistan thanked
them for attending the Judicial Conference 2014 and said that the
conference is an annual judicial event of Pakistani judiciary that
provides a common platform to International and National luminaries of
law, members of Bars and jurists to assemble and share their vision,
experiences and the best practices to evolve common strategies to
improve the system of Administration of Justice and to make it more
responsive to address the emerging challenges.

The delegates reciprocated the same sentiments and congratulated the
Chief Justice of Pakistan for holding and hosting such an
International event to enhance cooperation amongst the judiciaries of
different countries to take advantage of each others' wisdom and
experiences.

At the end of each meeting the Chief Justice of Pakistan presented
shields and souvenirs to delegates as gesture of goodwill.

I describe the modus operandi used to reserve tables for groups in the
DHC Canteen.

At around 1 pm, DHCBA staff arrive at their designated tables and
stake a claim to the table by laying plates, tiffin boxes etc on it.
These DHCBA staff have instructions to prevent and discourage
non-group lawyers from sitting at these tables. At the same time,
canteen waiters on standing instructions leave this area and stop
serving canteen food to "ordinary" lawyers who might sit on reserved
tables.

Once the group arrives, the DHCBA staff serves them, removes used
plates etc, provides cutlery, provides hand sanitisers etc. The groups
continue to occupy the reserved tables even after finishing their food
and then follow it up with conversation. They usually vacate these
reserved tables only after 2:15 pm.

Meanwhile ordinary lawyers keep standing and waiting for seats on the
left and less elite side of the canteen where there is less
reservation.

Several lawyers including senior and older lawyers often leave the
canteen without eating lunch because they cannot find a seat.

I have observed Meera Bhatia tell two ordinary lawyers to vacate a
reserved table and to move to the clerks section because "no one would
serve them" on the reserved table.

Today, I saw that only 3 persons were eating at Kirti Uppal's reserved
table and these 3 persons were being served by 3 DHCBA staff. One
DHCBA staff was killing flies at this table using a racket. There were
seats for 4 persons vacant at this table but ordinary lawyers could
not sit there because the table was "reserved".

Amit Chadha (designated senior advocate) appears to believe that the
corner table he has lunch on is "his" table by right.

This practice of reservation is not official but an informal
abberration which must end.

Facilities for lunch for lawyers must also be increased by provision
of additional canteens/ cafeterias.

I have recorded three videos today.

One of "elite" and "insider" lawyers eating in luxury on reserved
tables in the DHC cafeteria, being served by bar staff.

Second of "ordinary" lawyers eating in the 42 degrees heat in the open
air glass canteen where 5 fans out of 20 were working today.

Third of "ordinary" lawyers eating standing up in the heat at the
outside stalls next to a toilet amid a lot of garbage.

Most of the elite lawyers have chambers, but they reserve tables in
the canteen and sit there like at a club for one hour while other
lawyers leave or omit lunch because they cannot find a table.

I will be circulating these videos among the Bar.

The practice of reserving tables in the DHC canteen must end. Such
reservation does not happen in the Supreme Court.
